# BakePorch Terms of Use
**Effective date: October 24, 2026**
These Terms of Use ("Terms") govern your use of BakePorch (bakeporch.com), a platform owned and operated by IT Tech LLC ("BakePorch," "we," "us"). BakePorch lets independent home bakers and small food businesses ("Sellers") create online storefronts, and lets their customers ("Shoppers") browse and place orders.
By creating an account, visiting a storefront, or placing an order, you agree to these Terms and to our [Privacy Notice](/privacy). If you don't agree, please don't use BakePorch. Some sections apply only to Sellers or only to Shoppers and are labeled that way.
## 1. Accounts
- You must be at least 18 years old to create a Seller account.
- Sellers may add staff with limited roles (for example Manager or Production). Each staff member sets their own password and is bound by these Terms.
- You're responsible for keeping your login details private and for everything done under your account, including by staff you add. Tell us right away at support@bakeporch.com if you suspect unauthorized access.
- Shoppers may be able to check out as a guest, depending on the Seller's settings.
## 2. Seller responsibilities
As a Seller, you are solely responsible for:
- **Your listings.** The accuracy of your products, prices, descriptions, photos, ingredients and allergen information. BakePorch offers AI-assisted tools (such as storefront drafting, photo adjustment and recipe reading). You must review and correct anything they produce before publishing, and you remain responsible for it, including allergen disclosures.
- **Following the law.** All laws that apply to your business, including cottage food and health department rules, licensing or permits, food labeling, allergen disclosure, sales tax and any local requirements. BakePorch is a software platform, not a regulator. We don't verify that your business is licensed or compliant, and any regulation information we show is general guidance, not legal advice.
- **Your orders.** Fulfilling the orders you accept, honestly representing your bake dates, availability and pickup or delivery windows, and handling customer questions, refunds, complaints and food-safety concerns about your products.
- **Your staff.** The actions of anyone you give access to your account.
## 3. Orders and payments
- **Who you're buying from.** When a Shopper orders from a storefront, the sale is between the Shopper and that Seller. BakePorch provides the platform but is not the seller or a party to the sale.
- **Card payments** are processed by Square under Square's own terms. Payments go to the Seller's own Square account. BakePorch does not hold Seller funds.
- **Fees.** Depending on the Seller's plan, a BakePorch service fee may be added to card orders and paid by the Shopper or the Seller, as shown at checkout and on our [Pricing](/pricing) page. Square's processing fees are separate and are charged to the Seller by Square. Some plans have a monthly fee instead of a per-order fee.
- **Outside payments.** Where a Seller's plan allows it, a Seller may accept payment outside BakePorch (for example cash at pickup) and record it manually. Those payments are handled entirely between the Shopper and the Seller.
- **Refunds and changes** follow each Seller's own policies. If a Seller hasn't posted a policy, contact the Seller directly. If a card payment dispute can't be resolved with the Seller, Square's dispute process may apply.
## 4. Content and intellectual property
- **Your content stays yours.** Sellers keep ownership of the content they provide, including names, logos, photos, product descriptions and recipes. Private recipes and ingredient data stay private to your store unless you choose to publish them.
- **License to run your store.** You give IT Tech LLC a non-exclusive, worldwide, royalty-free license to host, store, process, adapt, display and distribute the content you submit (including your business name, logo, photos, story and product information), only as needed to operate your storefront and provide BakePorch's features. This includes AI-assisted generation and editing through our service providers, and showing your public storefront content in BakePorch materials (such as an example store or directory) unless you ask us not to. This license ends when you delete the content or close your account, except for copies we must keep for legal reasons, in backups, or that were already shared publicly.
- **You have the rights to what you upload.** You confirm that you own or have permission to use everything you upload, and that it doesn't infringe anyone else's rights or include other people's private information.
- **Our platform.** IT Tech LLC owns the BakePorch platform, software and brand. We give you a limited, non-exclusive, revocable license to use them as these Terms allow.
## 5. Things you may not do
You may not use BakePorch to:
- sell illegal goods or misrepresent what you're selling;
- commit fraud, including payment fraud or fake orders;
- scrape, reverse-engineer, overload or interfere with the platform;
- get around security or account controls, or abuse signup or rate limits;
- send messages to people without the consent the law requires;
- use another Seller's or Shopper's information for anything other than fulfilling their order.
## 6. Disclaimers
BakePorch is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the platform will be uninterrupted, error-free or secure, or that AI-assisted features will produce accurate results. Sellers must check all product, ingredient and allergen information themselves before publishing.
## 7. Limitation of liability
To the fullest extent the law allows, IT Tech LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of BakePorch. Our total liability for any claim relating to BakePorch is limited to the amount you paid us in the 12 months before the claim arose, or $100 if you paid us nothing.
## 8. Indemnification
You agree to defend and hold IT Tech LLC harmless from claims arising from your use of BakePorch, your violation of these Terms, your content, or (for Sellers) your products, food-safety practices, licensing or legal compliance.
## 9. Ending your use
- We may suspend or close an account that violates these Terms, misuses the platform, or creates legal or security risk, with notice where practical.
- You can close your account at any time by contacting support@bakeporch.com. Obligations such as open orders and amounts owed continue after closing.
## 10. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Colorado, and you consent to their jurisdiction.
## 11. Changes to these Terms
We may update these Terms. We'll post the new version here with a new effective date and let Sellers know about material changes by email or in the app. Continuing to use BakePorch after changes take effect means you accept the updated Terms.
